犯罪复合函数公式——基于规范犯罪论的论证

摘要 在论证了规范论的犯罪函数公式后,随着对规范论体系思考的深入,深感有必要对之前归纳的犯罪函数公式y=fx(AB)+Fx(cd)进行修正,以便更好地关照法律与刑法的关系,更好地关照刑事案件变量来源多样,各种因素叠加的复杂情况。本文探讨了自变量多元情况下,法律与刑法复合调整下的涉案行为呈现的新情况,基于法秩序(法价值)统一原理,在原y=fx(AB)+Fx(cd)的犯罪函数公式的基础上,运用复合函数的方法,通过增加“中间变量”和内层与外层函数关系的处理,对牵涉进入刑事案件中的所有(实体)因素按照规范论的逻辑重新梳理,全景式地对刑事案件在审理过程中涉及的犯罪构成进行了初步探讨。由此产生了有别于之前只取涉案行为的单一自变量归纳的上述犯罪函数公式,重新书写了规范论的犯罪函数公式:y=F[fx(AB)]+F[fx(cd)],并对这一函数公式进行了初步论证。 Following the illustrations on the composite function formula of crime from the perspective of norms,this paper conducts an in-depth reflection on the normative system and feels it compulsory to revise the aforementioned crime function formula“y=fx(AB)+Fx(cd)”so that we could better handle the relationship between general law and criminal law as well as the varied sources of criminal cases and the situation of complex factors for combined effects.First,we explore the pluralistic independent variables and their effects on the integration of general law and criminal law.Then,we present the conditions of new cases,and based on the unified principle of law order(law value)and the original function formula of crime“y=fx(AB)+Fx(cd)”we adopt the composite function method and add an“intermediate variable”in order to manage the relationship between internal and external functions.Finally,according to the normative theory we restructure the logic related to criminal cases and panoramically outline the crime composition for criminal cases in the process of trial.It is argued that the reformulated function formula of crime“y=F[fx(AB)]+F[fx(cd)]”is of more theoretical and practical significance as it differs from its predecessor which adopts only one independent variable.
