现行法律规范下互联网无证行医行为的认定问题初探

"互联网+医疗健康"作为新生医疗模式,可以为患者提供更加便捷的服务,近年来发展势头迅猛,但也存在一系列监管空白和难点。当前存在非医疗机构、非卫生技术人员在线上以各种形式开展诊疗活动的现象,给患者生命安全和健康带来一定风险。通过阐述诊疗活动定义及分析我国当前相关法律,厘清互联网无证行医行为的认定,在保护患者生命健康的同时引导"互联网+医疗健康"产业健康发展。

As a new medical mode, "Internet+ medical health" can provide more convenient services for patients.It already demonstrate the swift development momentum in recent years,but there are a series of regulatory gaps and difficulties.On the current existence of medical institutions,health and technical personnel in the online activities in various forms to carry out diagnosis and treatment of phenomenon,brings to the patients’ life safety and health risks.Medical behavior is defined and analyzed in this article through the current relevant laws and regulations,clarify the problem of Internet unlicensed medical behavior,as well as protect the patient’s life and health guide the healthy development of the industry "Internet+ medical health".
