摘要
平台用工的規制是我國勞動法上的難题。勞動法能否適用於平台用工,取決於平台與勞動者之間是否構成勞動關孫,而勞動關系認定的核心標準則是所謂從屬性。所以,‘平台用工是否構成勞動關’的問題,爭議焦點在於如何用從屬性標準來衡量平台用工。對此,學界產生了肯定說、否定說和分類討論說,分類討論說又包括所謂‘二分法’和‘三分法’等。
Introduction The regulation of platform employment is a difficult problem in the labor laws of China.Whether the labor law can be applied to the platform employment depends on whether the labor relation is constituted between platform and workers,and the core standard for determining the labor relation is the so-called subordination.Therefore,the issue of"whether the labor relation is constituted for the platform employment"focuses on how to measure the platform employment as per the standard of subordination.
