自动驾驶中“人机共驾”侵权责任问题研究 被引量:1

摘要 汽车发展到自动驾驶阶段,由于车联网和智能交通加入、责任主体多元化、专业技术规范缺失与侵权责任法律滞后,在交通事故中存在责任主体与因果关系难以确定、现有归责办法难以适用等问题。对此要将“人为因素参与”作为责任主体判断标准,建立自动驾驶技术及使用规范,并利用共同侵权行为处理办法解决责任分配问题,建立人与车辆责任明确,不同情况区分适用的“人机共驾”责任处理规则。 The development of automobiles has entered the stage of autonomous driving.With the internet of vehicles and intelligent transportation,the responsible subjects become diversified,leading to the lack of professional technical specifications and the lagging of tort liability laws,hence come problems such as the difficulty of determining the causal relationship between the subjects of accident responsibility and the difficulty of applying existing liability methods.In this regard,“human factor participation”should be regarded as the judgment standard of the responsible subject,and it is needed to establish autonomous driving technology and usage specifications,use joint infringement methods to solve the problem of liability allocation,so as to establish clear responsibilities between humans and vehicles,and differentiate between applicable human-machines in different situations responsibility handling rules for driving together.
