摘要
我国《宪法》中的人民民主原则为听证制度提供了深厚的宪法及法理基础,《民法典》《土地管理法》等法律对不动产征收的原则性程序进行了规定。但是我国在不动产征收方面仍然存在公私利益界定不清、征地补偿标准不一等问题。文章基于问题分析,从完善听证制度、建立规范的听证程序、明确听证范围、增强听证制度的可操作性等方面提出促进不动产征收听证程序适用的相关建议。
The principle of people's democracy in China's Constitution provides a profound constitutional and legal basis for the hearing system,the Civil Code,the Land Administration Law and other laws stipulate the principle procedures of the real estate expropriation.However,in China,there are still some problems in the real estate expropriation,such as unclear definition of public and private interests and different compensation standards for the real estate expropriation.Based on the problem analysis,the article puts forward relevant suggestions to promote the application of the hearing procedures of the real estate expropriation from the aspects of improving the hearing system,establishing standardized hearing procedures,clarifying the scope of hearing and enhancing the operability of the hearing system.
