粤港澳大湾区中药专利分析与思考

Analysis and Thinking on Patent of Chinese Materia Medica in Guangdong-Hong Kong-Macao Greater Bay Area

目的通过分析近5年粤港澳大湾区中药专利情况,了解粤港澳大湾区中药专利申请现状,为促进粤港澳大湾区中医药知识产权保护、中药创新发展与成果转化提供参考。方法检索ISPATENT专利检索分析平台2016-2020年粤港澳大湾区中药专利,从专利类型、专利法律效力及发明专利申请人、专利运营、有效发明专利主题等方面进行分析。结果2016-2020年粤港澳大湾区中药专利申请共13183件,其中以发明专利为主,有11505件;广州、佛山、深圳三市申请量最多;在全部专利申请中,包括有效专利2275件,专利有效率较低;发明专利中,有效专利仅829件;申请人以企业和个人申请为主;有效发明专利中,中药应用方面的专利最多,涉及的疾病主要包括皮肤科疾病、肿瘤、心血管疾病等,发生运营的发明专利主要集中在化妆品与护肤品领域。结论粤港澳大湾区中药专利申请动力十足,但专利质量偏低,应加强地区间合作、校企合作,培育高价值专利,实现中药应用方面的科技创新突破。

Objective To analyze the patent situation of Chinese materia medica in Guangdong-Hong Kong-Macao Greater Bay Area(GBA)in recent five years;To understand the current situation of patent application of Chinese materia medica in GBA;To provide reference for promoting intellectual property protection,innovated development and achievement transformation of Chinese materia medica in GBA.Methods ISPATENT retrieval database and analysis platform was used to search patent of Chinese materia medica from 2016to 2020 in GBA,and data were analyzed from patent type,patent legal effect,applicant,patent operation and effective invention patent subject.Results From 2016 to 2020,the GBA had a total of 13183 patent applications for Chinese materia medica,of which 11505 were invention patents;among all patent applications,2275 valid patents were included,which had a low patent efficiency;among the invention patents,there were only 829 valid patents;applicants mainly applied from enterprises and individuals;among the effective invention patents,the patents for the application of Chinese materia medica were the most,and the diseases involved mainly included dermatological diseases,tumors,cardiovascular diseases,etc.The invention patents that occur and operate were mainly concentrated in the field of cosmetics and skin care products.Conclusion In GBA,patent application of Chinese materia medica is full of motivation,but the quality of patent is low.Regional cooperation and cooperation between school and enterprises should be strengthened,and high-value patents should be cultivated,in order to realize scientific and technological innovation breakthrough in the application of Chinese materia medica.
