高校法治机构运行现状及其风险辨析——基于33所一流大学建设高校的调查

The Operating Status and Risk Analyses of Rule-of-Law Institutes in Universities: Based on a Survey of 33 Top Level HEIs

在深入推进全面依法治国背景下,高校法治化建设对提升治理能力和办好高质量教育有着深远意义。高校法治机构是推进依法治校、依法治教的重要组织载体,在推进法治化工作中起到了重要的积极作用。在对33所一流大学建设高校的调查中发现,高校法治机构在面对法治建设的新要求时,出现组织定位不清晰、人员队伍配备不足、机构设置不合理等现实问题,存在组织目标出现偏差、行政效率降低、法治机构力量有所弱化和职责泛化等潜在风险。面对这些问题,高校应进一步完善法治机构顶层设计,加强人员队伍配备,完善保障机制,推动高等教育法治化迈入新的发展阶段。

Under the background of in-depth promotion of the comprehensive rule of law,the construction of rule-of-law is going to have profound significance for promoting the governing ability of HEIs(Higher Education Institution)and reinforcing high-quality education.The HEIs rule-of-law agencies are critical carriers of advancing the rule of law and education,and play a crucial active role in the work of promoting the rule of law.In the survey of 33 first-class-university-construction universities,it was found that,when facing the new requirements of the construction of the rule of law,universities’legal institutions had encountered practical problems such as unclear organizational positioning,insufficient staffing,and unreasonable institutional settings.There were also potential risks such as deviation of organizational goals,the inefficiency of governing,weakening of the agencies,etc.To resolve those issues,HEIs should refine the top-level design of these agencies,enhance the team resource,and reinforce the guarantee system.The rule of law of higher education should move into a new stage.
