数字利维坦下的劳动者权益困境及对策分析

The Dilemma of Laborers’ Rights and Interests as well as Countermeasures Analysis under the Digital Leviathan

数字经济作为经济复苏、推动转型发展的重要抓手,在发展经济和促进就业方面有着重要贡献。但最先进入数字经济领域的头部互联网企业,凭借早期的技术、资本和数据积累,构建起"数字利维坦"(Digital Leviathan),进而通过数字技术及其自身的支配地位以更加隐蔽的方式控制劳动者,造成劳动者权益受损。数字利维坦造成劳动者权益保护困境的原因,既与数字经济下新的用工形式有关,也与社会保障相对滞后、部分企业违法用工、工会维权职能发挥不足有关。因此,应通过完善制度建设、健全社会保障体系、充分发挥工会的协调和监督作用等方式,强化对劳动者的权益保护。

As an important starting point for economic recovery and transformation,digital economy has made important contributions to economic development and employment promotion.However,the pioneering internet companies that entered the digital economy first built Digital Leviathan with early technology,capital and data accumulation,and then control workers in a more subtle way through digital technology and its own dominant position,resulting in the damage of workers’rights and interests.The reasons why digital leviathan causes difficulties in the protection of workers’rights and interests are not only related to the new forms of employment under the digital economy,but also related to the relative lag of social security,illegal employment of some enterprises and the insufficiency of the rights protection function of trade unions.Therefore,we should strengthen the protection of workers’rights and interests by perfecting system construction,perfecting social security system and giving full play to the coordinating and supervising role of trade unions.
