The Interpretation and Optimization of China’s Network Copyright Rule System

随着网络技术的发展与网络平台涉及领域的不断拓展,我国网络版权保护的发展也在经历发展完善动态过程,现有的法律规则体系在一定程度上发挥着平衡各方利益,打击网络版权侵权的积极作用,但同时也面临着规则碎片化与相互矛盾的窘境。本文通过对相关法律法规比较分析进行“拆解”与“配套”,使其准确适用并与现有规则顺畅衔接,通过对网络版权中“通知-移除”规则的有效性与及时性进行评估,强化网络平台与网络服务提供商在网络版权保护中的法律责任来实现对现有网络版权保护规则体系的优化。

With the development of network technology and the continuous expansion of network platforms involved in the field,the development of my country’s network copyright protection is also undergoing a dynamic process of development and improvement.The existing legal rule system plays a role in balancing the interests of all parties to a certain extent and combating network copyright infringement.However,it also faces the dilemma of fragmented and contradictory rules.This article conducts“dismantling”and“supporting”through comparative analysis of relevant laws and regulations to make it accurately apply and smoothly connect with existing rules,and evaluate the effectiveness and timeliness of the“notice-remove”rule in online copyright to strengthen the legal responsibilities of network platforms and network service providers in network copyright protection,which all help to achieve the optimization of the existing network copyright protection rule system.
