中国植物新品种育种技术专利现状及法律保护 被引量:4

Current Situation and Legal Protection of Breeding Technology Patents for New Plant Variety in China

摘要 植物新品种权是指完成育种的单位或个人对其授权的品种依法享有的排他使用权。在国际经济一体化的发展趋势下,植物新品种权越来越受到各国的重视。中国作为世界农业大国,植物新品种权的发展与发达国家相比,相对较晚,相关的法律法规尚未完善。本研究剖析了中国植物新品种权的发展现状以及在法律法规方面存在的问题以及缺陷,并与国外植物新品种权的发展现状和保护制度进行了对比分析,指出了中国目前植物新品种权保护方面存在的问题,从未来植物新品种权保护的发展趋势预测的角度给出了中国植物新品种权保护的对策建议,以期中国政府对植物新品种权保护工作的开展提供借鉴,力求实现植物新品种权产权法律和经济效益的平衡。 The right of new plant varieties refers to the exclusive right to use the varieties authorized by the breeding unit or individual according to law.Under the development trend of international economic integration,more and more countries pay attention to the right of new plant varieties.As a large agricultural country in the world,China develops relatively late in the right of new plant varieties,compared with developed countries,and relevant laws and regulations have not been improved.This study analyzed the development status of new plant variety rights in China and the problems and defects existing in laws and regulations,compares and analyzed the development status and protection system of new plant variety rights with foreign countries,and points out the problems existing in the protection of new plant variety rights in China.From the perspective of predicting the development trend of new plant variety right protection in the future,this paper gives the countermeasures and suggestions for the protection of new plant variety right in China,in order to provide reference for the Chinese government to carry out the protection of new plant variety right,and strive to achieve the balance between the property right law and economic benefits of new plant variety right.
