从种子法律体系角度论中国种业的发展趋势

On the Development Trend of China’s Seed Industry from the Perspective of Seed Legal System

种子是农业生产必备的生产资料,也是种业发展重要的元素,种业的发展程度更与国家的农业经济发展紧密关联。本研究从农业种子法律体系的角度出发,在分析了中国种业发展现状的基础上,指出中国农业种子法律体系构建现存问题,主要包括种子新品种保护制度不够完善、种子市场安全监管力度不足、种业规模化管理体系存在缺陷等。通过借鉴国外优秀的农业种子法律体系构建经验,进一步提出有针对性的农业种子法律体系完善建议,以期对中国政府更好地部署种业发展工作提供参考。

Seed is not only the necessary means of production for agricultural production,but also an important element for the development of seed industry.The development degree of seed industry is closely related to the national agricultural economic development.From the perspective of agricultural seed legal system,based on the analysis of the development status of China’s seed industry,this study points out that the existing problems in the construction of China’s agricultural seed legal system mainly include the imperfect protection system of new seed varieties,the insufficient safety supervision of seed market,and the defects in the large-scale management system of seed industry.By learning from foreign excellent experience in the construction of agricultural seed legal system,this paper further puts forward targeted suggestions on the improvement of agricultural seed legal system,in order to provide reference for the Chinese government to better deploy the development of seed industry.
