摘要
对于体育赛事直播画面而言,大部分体育赛事直播画面独创性较低,应将其认定为录像制品,而少数独创性较高的,可认定为作品。但无论是狭义著作权抑或录像制作者权,均无法规制他人未经许可的网络实时转播行为,这也会给权利人造成较大的损失。基于此,本文通过对网络环境下体育赛事直播画面的著作权保护路径的分析,提出了采用扩张信息网络传播权的方式规制转播行为的建议。
Regarding the live broadcast scenes of sports events,the majority of the them bear low originality and should be identified as video products,while a few with high originality can be identified as works.However,neither copyright nor video producer’s rights in the narrow sense can be regulated by other people’s unlicensed online real-time broadcast behavior,which will cause great losses to the right holder.Based on this,this article analyzes the copyright protection path of the live broadcast scenes of sports events in the network environment,and proposes a proposal to regulate the rebroadcasting behavior by expanding the propaganda right of information network.
