生态文明何以可能——一种基于法哲学维度的考察

What Makes the Ecological Civilization Possible——An Investigation Based on the Dimension of the Philosophy of Law

人类历经百万年的原始文明、一万年的农业文明和三百年的工业文明之路,生产力逐级提升。在不到三百年的工业文明中,不断增长的人口携消费主义理念,将地球生态系统糟蹋得面目全非,逼近生态阈值。为减轻地球生态荷载,夯实现代化建设的生态基础,党的十八大确立包括生态文明建设在内的“五位一体”的总体布局。对生态文明建设进行基于法哲学维度的研究,厘清生态文明建设的法哲学基础,从而为生态文明建设提供必不可少的法哲学支持,既是顺乎天而应乎人的法学完善自身的需要,也是生态文明建设的新视角和亟待解决的现实问题。

Through the undergoing of primitive civilization,agricultural civilization and industrial civilization,human productivity has been improved step by step.In industrial civilization,a growing population with consumerism has ruined the planet’s ecosystem and pushed it close to the ecological threshold.In order to reduce the ecological burden on the earth and consolidate the ecological foundation for modernization,the 18th National Congress of the Communist Party of China established the Five-sphere Integrated Plan,which covers the construction of the ecological civilization.In order to clarify the legal philosophical foundation of the construction of ecological civilization and provide the necessary legal philosophical support for the construction of ecological civilization,the research on the construction of ecological civilization based on the legal dimension is urgently needed not only for perfecting law in accordance with nature and human,but also for providing a new perspective of ecological civilization construction and a solution to the realistic problem.
