改革与法治相衔接中的立法条件及其类型

Legislative conditions and it's types in the connection between reform and rule of law

改革与法治相衔接、相统一,是习近平法治思想的重要论断。在实现改革决策与立法决策的对接中,应立足不同立法条件的情形,采取和运用不同立法行为方式。常态立法、授权(国务院)立法、(地方)先行立法、(授权)特区(变通)立法和法典立法分别与改革的不同分布、不同阶段相适应。之所以在我国通过立法法、授权法(决定)等构设阶梯式的立法条件及其对应的立法类型,在改革、发展的社会情势所成就的现实立法条件与法定立法条件相契合之际,科学选择立法类型,发挥法治引领、规范、保障作用,在根本上,是改革与法治两轮驱动、紧密结合的必然要求。但是,非常态条件下各个立法类型应强化建构性而并非停留在试验性。试验性立法是一种错误的归纳。现实立法条件与法定立法条件的吻合度,即现实立法条件的成熟度,是检验、评价立法行为是否“适时”“及时”,进而认定未做出立法决策是否构成立法过程中怠于履行职责、乃至立法不作为的要件之一。

The connection and unification of reform and the rule of law are important assertions in Xi Jinping's thought of rule of law.In the process of realizing the connection between reform decision-making and legislative decision-making,we shall adopt and apply different forms of legislative acts based on different legislative conditions.Normal legislation,delegated legislation,prior legislation,special zone legislation and code legislation are applicable in different distribution and different stages of the reform.The reason why China has adopted legislation law,delegated law(decision),etc.to create ladder-type legislation conditions and the corresponding legislation types,it requires that at the time when the realistic legislation conditions made under the social circumstances of reform and development are in line with the statutory legislation conditions,the legislation type shall be scientifically selected and a guiding,regulating and safeguarding role of the rule of law shall be given play to,fundamentally,the two-wheel drive and the close combination of the reform and the rule of law.Under the abnormal legislation conditions,we should strengthen the constructiveness rather than remain at the experimental level.The compatibility between the actual legislative conditions and the statutory legislative conditions,the maturity of the actual legislative conditions,is one of the important elements to test and assess whether a legislative act is timely and timely and whether a failure to make legislative decisions constitutes an omission of duties during the legislative process.
