个人信息保护视域下知情同意框架的应用困境与对策探析

The application dilemma and countermeasures of informed consent framework from the perspective of personal information protection

随着大数据时代的不断发展,知情同意框架作为个人信息保护视域内的基本原则,存在形式主义严重、条款模糊、不能反馈多样化意见等现实应用困境,将难以约束企业的个人信息收集处理行为。从用户因素、企业因素、客观因素3个角度剖析了知情同意框架存在应用困境的原因,并将根本原因总结为用户和企业处在信息不平等地位。为降低用户和企业的信息势差,增加用户对其个人信息收集处理的控制力,从完善法律规制、加强监督检查、引入市场化机制、创新分层动态同意机制、完善事后救济等角度探析对知情同意框架的完善。

With the continuous development of the technology in big data,informed consent framework,as a basic principle in the field of personal information protection,has some practical application difficulties,such as serious formalism,vague terms,lack of feedback of diversified opinions,etc.,which will be difficult to restrict the personal information collection and processing behavior of enterprises.This paper analyzes the reasons for the application dilemma of informed consent framework from three aspects of user factor,enterprise factor and objective factor,and summarizes the fundamental reason as that users and enterprises are in the unequal position of information.In order to reduce the information gap between users and enterprises and increase users’control over collection and processing of personal information,this paper analyzes the improvement of the framework of informed consent from the perspectives of improving legal regulations,strengthening supervision and inspection,etc.
