服装出口贸易涉外定牌加工的商标侵权认定问题探究

Study on Determination of Trademark Infringement Concerning Original Entrusted Manufacture In Apparel Export Trade

本文以服装定牌加工类案件为视角,结合商标法理论对服装出口贸易定牌加工的商标侵权认定问题进行研究。针对此类涉外定牌加工案件,首先必须明确商标侵权要以侵权意义下“商标使用”作为构成商标侵权成立的行为要件,要求商标进行贴附并在客观上发挥了来源识别功能。其次,“混淆可能性”是商标侵权的结果要件,在判断定牌加工是否涉及商标侵权具有逻辑顺序,应当先认定涉外定牌加工案件中行为人具有“商标使用”行为,并且造成“混淆可能性”的结果,商标侵权才得以成立。

This article takes the case of original entrusted manufacture of garments as a perspective,and explores the infringement determination of trademark infringement in the case of original entrusted manufacture in conjunction with the theory of trademark law.In the case of original entrusted manufacture,it must first be clear that trademark infringement is based on the"use of the trademark"in the sense of infringement,which requires the trademark to be attached and objectively play the function of source identification.Secondly,"likelihood of confusion"is the result element of trademark infringement,and in determining whether or not the original entrusted manufacture involves trademark infringement,there is a logical sequence,and the perpetrator in the original entrusted manufacture case should first be found to have"trademark use"and cause"likelihood of confusion"is the result before trademark infringement can be established.
