摘要
食品安全犯罪的重刑化刑事政策立法体现在食品安全犯罪类罪名增多、入罪门槛较低以及刑法打击力度加大。食品安全犯罪重刑化刑事政策面临规制该类违法犯罪行为的行刑衔接不够协调、违法犯罪行为治理的信息交流不够通畅以及司法适用偏离重刑化刑事政策的轨道等问题。一方面应通过建构社会共治体系防治食品安全违法犯罪行为,另一方面重刑化立法不应超出比例原则的限制。当前拓展食品安全犯罪的环节为时尚早。生产、销售不符合安全标准的食品罪等罪名设无限额罚金刑存在不妥,应改为设上限和下限的罚金制。还要确保法院对适用缓刑的食品安全犯罪的行为人同时宣告禁止令以及规范适用禁业规定。
The criminal policy of severe punishment of food safety crime has embodied crime increases,reduced the threshold conviction and enlarged the strike dynamics.It faces many problems,the combination of Administrative Law and Criminal Law is not in keeping,communication about illicit or criminal acts is not unobstructed,judicial application away from criminal policy of severe punishment.Social co-governance could regulate food safety offence and severe punishment is in accord with the proportional principle.At present,extending the tache of food safety crime is still to early.The crime of produces or sells food not up to the food safety standards of non-quota fine is not proper and should adopt numbered fine.The court should declare suspended sentence and injunction at the same time.And it is suitable for use the rule of the prohibit undertaking specific professions.
