《中美经贸协议》背景下我国商业秘密刑事规则的重构

Reconstruction of China’s Criminal Rules of Trade Secrets under the Background of China-US Economic and Trade Agreement

商业秘密问题在中美贸易关系中占据重要地位,日渐成为中美贸易摩擦的核心内容。《中美经贸协议》对商业秘密刑事保护提出了更高的要求,在此背景下,我国迅速制定和修改了相关的法律法规,对我国的商业秘密刑事保护规则进行了全面重构。通过对新规则进行评析,针对其不足提出进一步细化和完善建议,使之更符合《中美经贸协议》的规则,也有利于司法实践在处理此类案件时的稳定性和一致性。

The issue of trade secrets plays an important role in Sino-US trade relations and it has gradually become the core content of Sino-US trade frictions.China-US Economic and Trade Agreement puts forward higher requirements for the protection of trade secrets.In this context,China quickly formulated and revised relevant laws and regulations,and carried out a comprehensive reconstruction of China’s criminal rules on trade secrets.Through the evaluation of the new rules,further refinement and improvement suggestions are put forward to make them more in line with the rules of China-US Economic and Trade Agreement,and it is also conducive to the stability and consistency of judicial practice in handling such cases.
