党内监督“规范空间”的系统逻辑与实现

作为“完备、高效、严密、有力、完善”的“法律规范、法治实施、法治监督、法治保障、党内法规”五大法治体系重要组成部分,党内法规体系的系统完备性、严密性、协调性是直接关系到社会主义法治国家建设的重大理论问题。作为党内法规体系的重要组成,党内监督法规体系建设不仅关系到党内制度机制运行高效性,也涉及到整个法规体系系统运行的稳定性。因此,在党内法规研究中尝试引入以系统空间理论为主要方法的研究范式,探索系统思维与法治思维有效衔接的研究路径,对于促进党内监督“规范空间”理论探讨与法治实践有机结合,具有理论可行性和现实价值意义。

As an important part of the five major legal systems of"legal norms,implementation of the rule of law,supervision of the rule of law,guarantee of the rule of law and regulations within the party",which are"complete,efficient,strict,powerful and perfect",the system completeness,strictness and coordination of the regulations within the party are related to the major theoretical and practical issues of the construction of a socialist country ruled by law.As an important part of the inner-party legal system,the construction of the inner-party regulatory system is not only related to the efficiency of the operation of the inner-party system mechanism,but also to the stability of the whole legal system.Taking Marxist materialist dialectics as the basic methodology,using systematic thinking and methods,integrating the advantages of various research paradigms,and promoting the organic combination of theoretical research on u normative spacen of inner-party supervision and practice of rule of law have theoretical feasibility and practical significance.
