以深化“放管服”改革为抓手 推进法治政府建设

Promoting the Construction of Government under the Rule of Law by Deepening the Reform of“Streamlining Administrative Process and Delegating Power,Strengthening Regulation and Improving Services”

法治政府建设与深化"放管服"改革、优化营商环境有着不可割裂的内在关联:法治的精髓在于限制权力,保障权利;"放管服"改革的要义在于限制权力、规范权力。这种内在关联决定了两者之间存在着相互作用、相互促进的关系,因此从深化"放管服"改革、优化营商环境入手推进法治政府建设是必然的选择。从"放管服"改革的实际进程出发,目前有关深化"放管服"改革的法治建设可考虑从规范清单制度、清理法律法规和加快立法进程三个方面着手推进。

The construction of governments under the rule of law is intrinsically linked to the deepening of the reform of“streamlining administrative process and delegating power,strengthening regulation and improving services”and the optimization of the business environment.The essence of the rule of law lies in limiting power and safeguarding rights,and the essence of the reform of“streamlining administrative process and delegating power,strengthening regulation and improving services”lies in limiting and regulating power.This intrinsic linkage determines the interaction and mutual promotion between the two.Therefore,it is an inevitable choice to promote the construction of governments under rule of law by deepening the reform and optimizing the business environment.From the perspective of the actual progress of the reform of“streamlining administrative process and delegating power,strengthening regulation and improving services”,the current construction of rule of law for deepening the reform can be promoted from three aspects:standardizing the list system,clearing up laws and regulations and speeding up the legislative process.
