我国个人信息保护工作的推进现状研究——基于《中华人民共和国个人信息保护法(二审稿草案)》的文本解读

The Promotion Status of Personal Information Protection in China——Based on Data Analysis and Connotation Interpretation of the Policy Text Which Is"Personal Information Protection Law of the People’s Republic of China(Draft 2nd)"

【目的/意义】个人信息保护政策作为公民个人信息保护的法律保障依据,具有重要的研究价值,将词频分析、社会网络分析法、内容分析法用于政策解读与分析,推动我国个人信息保护工作的进一步开展。【方法/过程】本文以《中华人民共和国个人信息保护法(二审稿草案)》(2021年4月29日发布)的政策文本为研究对象,运用词频分析、社会网络分析法、内容分析的方法,对该法律草案文本进行研究,从而达到以更多视角挖掘分析法律政策条款内涵的目的,以法律文本的分析为依据完成对我国个人信息推进现状的描述。【结果/结论】通过定量与定性相结合的研究方法,解读《中华人民共和国个人信息保护法(二审稿草案)》,归纳并揭示法律文本中所蕴含的个人信息保护工作的运行机理,明确我国个人信息保护立法的进程。【创新/局限】综合运用词频分析、社会网络分析法及内容分析法解读《中华人民共和国个人信息保护法(二审稿草案)》的内容。但本文只针对我国个人信息保护的现状进行了分析,并未涉及策略、改进方法等更进一步的讨论。

【Purpose/significance】Personal information protection policy,as a legal basis for the protection of citizens’personal information,has important research value.The word frequency statistics,social network analysis and content analysis method are used for policy interpretation and analysis to promote the further development of my country’s personal information protection work.【Method/process】This article takes the policy text of the"Personal Information Protection Law of the People’s Republic of China(Draft 2 nd)"(Released on April 29,2021)as the research object,with the method of the word frequency statistics,social network analysis and content analysis method to study the text of the draft law,so as to achieve the purpose of digging and analyzing the connotation of legal policy clauses from more perspectives,and complete the description of the current situation of my country’s personal information promotion based on the analysis of the legal text.【Result/conclusion】Interpret the"Personal Information Protection Law of the People’s Republic of China(Draft 2 nd)"through a combination of quantitative and qualitative research methods,summarize and reveal the operating mechanism of personal information protection contained in the legal text,make clear the process of personal information protection legislation in our country.【Innovation/limitation】The innovation of this article lies in the comprehensive use of word frequency analysis,social network analysis and content analysis to in-depth interpretation of the"Personal Information Protection Law of the People’s Republic of China(Draft for Second Review)".However,this article only analyzes the current situation of personal information protection in my country,and does not involve further discussions on strategies and improvement methods.This point can be discussed in the following article.
