论空间建设用地使用权地下空间界限的明晰

摘要 在《民法典》空间建设用地使用权的落实过程中,存在地下空间界限难以明确的实践困境。空间建设用地出让合同中,地下空间界限划分多依赖事先行政规划对建筑物高度的限制。基于现阶段城市地铁、地下通道、管廊等建设开发需求,从城市集约用地、可持续发展的原则出发,应当对空间建设用地地下开发规划予以重视和明确。就空间建设用地使用权地下空间开发界限这一问题,可采用"事先规划"与"事后验收"相结合的模式,建立合理的预先规划与利益协调机制,通过司法解释和学理解释实现空间建设用地使用权理论与实践更好的衔接。 In the process of implementing the right to use space construction land in the Civil Code,there is a practical dilemma that it is difficult to define the boundary of underground space.In the space construction land transfer contract,the division of underground space boundary mostly depends on the restriction of building height by prior administrative planning.Based on the construction and development needs of urban subway,underpass and pipe gallery at the present stage,and based on the principles of urban intensive land use and sustainable development,we should pay attention to and clarify the underground development planning of space construction land.On the issue of underground space development boundary of space construction land use right,we can adopt the mode of combining“prior-planning”and“post-acceptance”,establish a reasonable prior-planning and interest coordination mechanism,and realize a better connection between theory and practice of space construction land use right through judicial interpretation and theoretical interpretation.
