国际人权法与基层治理:以儿童权利为例

The Role of International Human Rights Law in Grassroots Governance:An Example of Children's Rights

保障人权、实现良法善治是基层治理的目标。法治思维和法律方法在基层治理中具有重要意义。国际人权法使国际法与国内法发生更紧密的联系。国际人权法具有产生法律义务、承载道义责任和蕴含法律文化的三重作用,可以在社会治理中发挥作用。国际人权标准的实现主要依靠国内的努力,特别是基层社会的努力。因此,国际人权法的实施与基层治理具有密切的联系。本文以儿童权利为例,阐明人权的普遍性原则、国际标准与本国国情及当地实际相结合,可以更好地促进基层治理、保护人权,也有助于形成先进的治理经验,促进国际交流和相互借鉴。

Safeguarding human rights and achieving good governance with good law is the goal of grassroots governance.The rule of law thinking and legal methods are of great significance in grassroots governance.International human rights law makes international law have much closer contact with domestic law than before.International human rights law,producing legal obligations,carrying moral responsibilities and bearing profound legal culture,can play a significant role in social governance.The implementation of international human rights standards mainly relies on domestic efforts,especially the efforts of grassroots society.Therefore,the implementation of international human rights law is closely related to grassroots governance.This paper uses children's rights as an example and clarifies how the international human rights law can be integrated into the social governance with due consideration of both national and local conditions.It is suggestsd that combination of the international human rights law with the local social development can better promote grassroots governance,protect human rights,help to form advanced governance experience,and promote international exchanges and cooperation.
