摘要
大数据时代,算法价格歧视问题日益凸显。算法价格歧视具有智能性、隐蔽性、技术优势性和双向互动性等特征。算法价格歧视可以分为基于消费者属性数据的静态算法价格歧视和基于消费者行为数据的动态算法价格歧视。当前,想要用法律来规制算法价格歧视面临着法律性质难以界定、法律规则难以适用、法律责任难以认定的困境,对此,必须明确算法价格歧视的法律性质,完善《消费者权益保护法》的相关规则,并进一步明确行为主体的法律责任。
Algorithmic price discrimination,which features intelligence,concealment,superiority in technology,and two-way interaction,has become an increasingly prominent problem in the big data era.It can be divided into two types,the static one based on the data of consumer attributes and the dynamic one based on the data of consumer behaviors.Presently,the difficulty in defining the nature of legislation,applying statutory rules and identifying legal liabilities are the obstacles to legally regulating algorithmic price discrimination.Therefore,it is of great necessity to clarify the legal nature of algorithmic price discrimination,improve the relevant rules of the Laws of the PRC on the Protection of the Rights and Interests of Consumers,and further define the legal liabilities of the subject.
