面向单轨制改革的广东省电子文件证据法规政策探析

An Analysis of the Regulations and Policies of Electronic Records Evidence in Guangdong Province Facing Single-track System Reform

从法规政策上赋予电子文档证据效力是推进电子文件单轨制改革的重要支点。通过梳理近二十年来广东省电子文件证据法规政策的内容、类型及其司法应用,详细分析了广东省电子文件证据法规政策特点,指出电子文件证据尚未形成完整法规体系;电子文件证据基本问题规定混乱,可采性与证明力应用处于初级阶段;电子文件证据真实性难以判定,司法实践存在操作障碍等一系列问题。并从完善电子文件证据法规体系、电子文件证据可采性及证明力、电子文件证据技术鉴定司法应用等维度,提出了构建多层次一体化的电子文件证据法规政策体系,开展电子文件证据可采性与证明力立法研究,提升司法应用中电子文件证据鉴定技术应用等广东省电子文件证据立法对策。

To enforce the electronic records evidence in laws and policies is an important fulcrum of promoting the single-track mode of electronic records.Based on a systematic reviews of the contents,types and judicial applications of the regulations and policies of the electronic records evidence in Guangdong province in the past two decades,the characteristics of the regulations and policies related to the electronic records evidence are analyzed in details,and there are still some problems such as incomplete legal system of electronic records,confused basic rules related to the electronic records evidence,less application in relate to admissibility and evidential power of electronic records.Also it is difficult to judge the authenticity of the electronic records evidence,and a series of problems such as operation obstacles are in real judicial practices.At last to improving the legal system,the admissibility and evidential power and the judicial application of the electronic records evidence in Guangdong province,it proposes counter measures such as forming a multi-level&integrated legal policy system,carrying out legislative researches on the admissibility and evidential power of the electronic records evidence,improving identification technology of the electronic records evidence in judicial application.
