环境行政执法与刑事司法衔接的监督机制困境及突破——以检察监督为视角

Difficulties and breakthroughs in the supervision mechanism of the linkage between environmental administrative law enforcement and criminal justice:from the perspective of procuratorial supervision

环境行政执法与刑事司法衔接不畅,原因之一是检察监督缺失。获取环境执法信息不畅,导致检察监督启动难;破除获取信息困境后,移送标准却与生态环境损害特质相矛盾,导致案件移送难;即便移送标准改变,由于证据的衔接适用存在分歧,公诉机关并不能有效提起公诉或者在审判阶段进行有效控诉。建议建立长效联动机制,改变案件移送标准,健全证据衔接制度,将行政检察部门从民事行政检察部门中独立出来。

The connection between environmental administrative law enforcement and criminal justice is not smooth,and one of the reasons is lack of procuratorial supervision.Poor access to environmental law enforcement information leads to difficult initiation of procuratorial supervision;after breaking the information dilemma,the transfer standard is inconsistent with the characteristics of ecological environment damage,which leads to the difficulty of case transfer.Even if the transfer standard is changed,the public prosecution authority may not be able to effectively initiate the prosecution,or the prosecution may not be able to effectively prosecute at the trial stage due to differences in the connection and application of evidence.To solve the above difficulties,a long-term linkage mechanism should be established,the transfer standard changed,the system of linking evidence improved,and the administrative procuratorial departments independent among the civil administrative procuratorial departments.
