摘要
基于请求权的基本法理和现有职务发明报酬的相关规定,可以证成职务发明报酬请求权。职务发明报酬请求权是一种意在保障职务发明人分享创新利益的债权请求权,而在我国现行职务发明制度背景下,职务发明报酬请求权的行使面临诸多现实障碍,这客观上导致职务发明人利益受损,进而影响激励发明人创新的社会效果。从请求权实现的视角来看,应弥补职务发明的制度漏洞,合理规制企业的机会主义行为,弹性规定职务发明报酬的法定标准,合理限定有关职务发明报酬的"约定",在司法实践中明确适用举证妨碍规则。
Based on the basic legal principle of the claim right and the relevant provisions of the existing service invention compensation, the service invention compensation claim right can be proved.The service invention compensation claim right is a creditor’s right to ensure that the service inventor shares the innovation benefits.Under the background of China’s current service discovery system, the exercise of the service invention compensation claim right faces many practical obstacles, This objectively leads to the damage of the interests of job inventors, and then affects the social effect of encouraging inventors to innovate.From the perspective of the realization of the right of claim, we should make up for the institutional loopholes of service invention, reasonably regulate the opportunistic behavior of enterprises, flexibly stipulate the legal standard of service invention remuneration, reasonably limit the “agreement” on service invention remuneration, and clearly apply the obstruction of proof rule in judicial practice.
