论民间法的场域公共秩序逻辑——基于广义法哲学视角之民间法的基石法理型构

On the Field Public Order Logic of Folk Law:Constructing the Cornerstone Jurisprudence of Folk Law from the Perspective of the Broad Law Philosophy

要摆脱当前法学舆论格局中的被动地位,民间法须型构自己的基石法理逻辑。国家法的基石法理是政治秩序逻辑,民间法的法理型构方法是场域逻辑,以国家法的基石法理为参照,基于民间法的法理型构方法,民间法的基石法理则可确定为场域公共秩序逻辑。民间法遵循着场域公共秩序逻辑有三方面的基本表现:其一,民间法处理国家范围内不同区域或领域,亦即各种场域法域中国家法没有顾及的社会纠纷;其二,民间法处理各种场域法域中国家法顾及起来“不经济”的社会纠纷;其三,民间法处理各种场域法域中国家法难以解决彻底的社会纠纷。

To get rid of the passive position in the current legal research public opinion,folk law must form its own cornerstone legal logic.The cornerstone jurisprudence of state law is the logic of political order,and the jurisprudential construction method of folk law is field logic.With reference to the cornerstone jurisprudence of state law,based on the jurisprudential construction method of folk law,the cornerstone jurisprudence of folk law is the logic of field public order.Folk law follows the logic of field public order,which is basically manifested in three aspects.Firstly,folk law deals with social disputes in different regions or fields within the country,that is,social disputes that are not taken into account by state law in various fields.Secondly,folk law deals with the“uneconomical”social disputes in those various regions or fields.Thirdly,folk law deals with the social disputes in those various regions or fields,which state law is difficult to be solved completely.
