“案-件比”规制下补充侦查的展开

The development of Supplementary Investigation under the Regulation of“case-case ratio”

“案-件比”是诉讼效率的体现方式,是发生的案件与其进入诉讼程序次数的比率,理想状态体现为1∶1。补充侦查是侦查活动的延续,是弥补侦查活动不足的必然手段,在刑事诉讼中发挥着进一步查清案件事实、完善证据体系、保障公诉质量的重要作用。实践中存在着补充侦查权被滥用、补充侦查效果不理想、犯罪嫌疑人被超期羁押等问题,必然会给“案-件比”带来影响,多数情况下会导致诉讼迟延,“案-件比”增高。准确适用最高人民检察院、公安部《关于加强和规范补充侦查工作的指导意见》,建立统一的证据标准和规范的补充侦查机制,强化自行补充侦查,构建“三位一体”(介入引导、规范退查、均衡结案)办案模式是解决相关问题的可行路径。

“case-case ratio”is the embodiment of litigation efficiency.It is the ratio of the number of cases and the number of litigation procedures.The ideal state is 1∶1.Supplementary investigation is a continuation of investigation activities and an inevitable means to make up for the inadequacy of investigation activities.It plays an important role in further investigating the facts of the case,perfecting the evidence system and guaranteeing the quality of public prosecution in criminal proceedings.In practice,there are some problems such as the abuse of supplementary investigation power,the unsatisfactory effect of supplementary investigation,and the prolonged detention of criminal suspects,which will inevitably affect the“case-case ratio”and lead to the delay of litigation in most cases,and the“case-case ratio”will increase.Accurate application of the Supreme People’s Procuratorate,the Ministry of Public Security The Guiding Opinions on Strengthening and Standardizing the Supplementary Investigation Work,establish a unified evidence standards and norms of supplementary investigation mechanism,strengthen the supplementary investigation on its own,to construct“the trinity”(intervention and guidance,standard check back,balanced case closure)case model is feasible to solve the problem of the path.
