旧村庄改造开发权益转移政策研究--以广州市为例

Research on the Rights and Interests Transfer Policy of Old Village Reconstruction and Development--a Case Study of Guangzhou City

旧村庄改造是提升城市功能品质、提高存量建设用地利用效率的重要途径,但是现实中存在较多旧村庄因新建建筑高度受到特殊控制区规划限制而难以实现盈亏平衡,造成城市更新受阻。本文以广州市为例,分析了旧村庄改造因受规划限制而难以实施的困境,对广州市开发权益转移的探索历程和典型案例进行了回顾,分析了开发权益认定缺乏标准、控规弹性不足、转入区开发强度过高、跨行政区域转移存在利益障碍等实施难点,并提出旧村庄改造开发权益转移的政策建议,以缓解不同区域间旧村庄改造土地权益价值不平衡、不充分的矛盾,实现兼顾改造主体的开发权益和社会公众公共利益的双重目标。

The reconstruction of old villages is an important way to improve the quality of urban function and the utilization efficiency of the existing construction land.However,in reality,many old villages are difficult to achieve profit and loss balance because the height of new buildings is limited by the planning of special control area,which hinders the urban renewal.Taking Guangzhou as an example,this paper discusses the difficulties of old village reconstruction due to planning constraints,reviews the exploration process and typical cases of development rights and interests transfer in Guangzhou,and analyzes the implementation difficulties such as lack of standards for the identification of development rights and interests,insufficient flexibility in regulatory planning,excessive development intensity in transfer areas,and interest barriers in cross-administrative transfer,and put forward the old village transformation development rights and interests transfer policy recommendations to alleviate the imbalance and insufficiency of land rights in different regions,and to achieve the dual goals of giving consideration to the development rights of the main body of the transformation and the public interests.
