办理性侵害未成年人案件的理念转变与启示

Handling Cases Involving Sexual Abuse Against Minors:Conceptual Transformation and Legal Revelation

与普通刑事案件相比,性侵害未成年人案件具有显著的特殊性。公安和司法机关应当以不同于办理普通刑事案件的理念办理这类案件。然而在实践中,办案人员深受传统办案理念的影响,往往以犯罪嫌疑人、被告人为关注焦点,以推动刑事诉讼进程为工作导向,以办理普通刑事案件的方式取证和运用证据,在很大程度上忽视了性侵害未成年人案件的特殊性。为了更好地保护未成年被害人,公安和司法机关应当以最有利于未成年人原则和国家责任原则为指引,尽快转变办案理念。在理念转变的基础上,公安和司法机关应当积极调整思路,以最有利于未成年被害人的方式办理这类案件,并充分履行保护未成年被害人的国家责任。

Compared with ordinary criminal cases,cases of sexual assault on minors exhibit significant particularity.Public security and judicial organs should handle such cases with a concept different from that of ordinary criminal cases.However,in practice,investigators are deeply influenced by traditional legal concepts.They often focus on the suspect and the defendant,and seek to promote the process of criminal proceedings.In order to obtain evidence and apply evidence in handling ordinary criminal cases,the particularity of cases involving sexual assault against minors is largely ignored to some extent.In order to better protect juvenile victims,public security and judicial organs should transform the concept of handling cases as soon as possible under the guidance of the principle of the best interests of the child as well as the principle of state responsibility.On the basis of such a conceptual transformation,public security and judicial organs should actively adjust their thinking,handle such cases in the way most conducive to juvenile victims,and fully fulfill state responsibility to protect juvenile victims.
