共享经济环境下消费者义务构建研究

On the Construction of Consumer Obligations Under the Environment of Sharing Economy

摘要 鉴于共享经济双边市场的运营逻辑,共享平台秩序的维护离不开消费行为的规范。消费行为的负外部性会对经营者、消费者和公共利益造成侵害,而目前的民法、合同法等私法体系不能调整消费失范行为,故有必要通过赋予消费者公法义务,为公权力介入消费行为监管提供法律依据。文章认为,对消费行为进行规制,必须冲破主体立法和特定主体权利倾斜保护的沉疴,通过权义一致平衡消费者、经营者和社会公共利益。同时,以消费者权利和消费行为的伦理环境为依据,构建消费者义务体系。 In view of the operation logic of the bilateral market of the sharing economy,the maintenance of the order of the sharing platform is inseparable from the standardization of consumption behavior.The negative externality of consumer behavior will infringe on the operators,consumers and public interests.However,the current private law systems,such as civil law and contract law,cannot adjust consumer anomie behavior.Therefore,it is necessary to provide a legal basis for public power to intervene in the supervision of consumer behavior by giving consumers public law obligations.The article holds that,to regulate consumer behavior,we must break through the depression of subject legislation and preferential protection of specific subject rights,and balance the interests of consumers,operators and the public through the consistency of rights and interests.At the same time,based on the ethical environment of consumer rights and consumer behavior,build a consumer obligation system.
