论“三治融合”理念下人民调解制度的重构路径

On the reconstruction path of the people’s mediation system under the concept of"three-governance integration"

目前中国乡村正处于由传统向现代化转变的关键时期,乡村社会涌现出一些现有乡村治理体系难以解决的新矛盾。党的十九大提出了健全"三治融合"的乡村治理新形态,人民调解制度的内涵与"三治融合"乡村治理体系的特征相洽,能够为解决乡村社会新矛盾、提高乡村治理能力提供重要支撑。但伴随着乡村社会的发展,人民调解制度也出现了解纷能力弱化的情况,基于此,需要加强人民调解员队伍建设、加大政府购买服务、加快村规民约的革新和提升人民调解协议的公信力以提高人民调解制度的基层治理能力。

At present,China’s rural areas are in a critical period of transformation from tradition to modernization,and some new contradictions that the existing rural governance system is difficult to solve have emerged in the rural society.The 19 th National Congress of the Communist Party of China proposed to improve the new form of rural governance of"three-governance integration".The connotation of the people’s mediation system is consistent with the characteristics of the"three-governance integration"rural governance system,which can provide important support for solving new contradictions in rural society and improving rural governance capacity.However,with the development of rural society,the people’s mediation system has weakened its ability to understand disputes.Based on this,it is necessary to strengthen the construction of the team of people’s mediators,increase the government’s purchase of services,speed up the innovation of village rules and regulations and enhance the credibility of people’s mediation agreement to improve the grass-roots governance capacity of people’s mediation system.
