试论组织代孕行为的刑法规制

On the Criminal Regulation of Organized Surrogacy

组织代孕行为是指将需要代孕的人、有意向为他人代孕的人以及可以实施代孕技术的人联系起来,有序地开展代孕活动的行为,组织代孕行为的社会危害性日益凸显,对行为人组织他人实施代孕的行为,以现有犯罪的从犯追究行为人的刑事责任,不仅存在刑事处罚上的漏洞,且量刑畸轻,有违罪刑相适应的刑法基本原则。为了有效地规制非法代孕,我国有必要考虑在刑法分则第六章的妨害社会管理秩序罪中增设关于组织代孕行为的刑事规定。

Organization of surrogacy refers to the behavior of connecting people who need surrogacy,those who intend to carry out surrogacy for others and those who can carry out surrogacy technology,and carrying out surrogacy activities in a partial and orderly manner.The social harmfulness of organizing surrogacy is becoming more and more prominent,the act of someone organizing others to carry out surrogacy,if pursue these people criminal responsibility as an existing crime accessory,not only is there a loophole in the punishment,but the sentencing is unusually light,it violates the basic principle of criminal law that crime and punishment fit together.In order to effectively regulate illegal surrogacy,it is necessary for our country to consider adding criminal provisions on organizing surrogacy in the sixth chapter which obstructing the social order of the criminal law.
