摘要
劳动者生物识别信息特殊保护不足,具体表现为对劳动者生物识别信息的立法保护缺少特殊性,劳动者知情同意形式化失效与保护预期悖反,职业评估影响升级与就业歧视的风险。劳动者生物识别信息保护具有多元权利属性,需要结合劳动关系从属性特征平等保护。劳动者生物识别信息保护法律应对之原则包括:劳动者知情同意原则、比例原则、严格雇主责任原则。在具体安排上,劳动者生物识别信息保护应通过立法保护的方式,提供基本内涵的统一标准和合理范围,并通过技术方式辅助立法实现范围的可控。
The special protection of workers'biometric information is insufficient,which is manifested in the lack of special legislative protection of workers'biometric information,the failure of formalizing workers'informed consent and the contradiction of protection expectation,and the risk of escalation of professional assessment and employment discrimination.The protection of workers'biometric information has multiple rights,and needs to be protected equally with the subordinate characteristics of labor relations.The principles of legal response to the protection of workers'biometric information include the principle of workers'informed consent,the principle of proportionality,and the principle of strict employer responsibility.The specific arrangements for the protection of workers'biometric information provide the unified standard and reasonable scope of the basic connotation by means of legislative protection,and the controllable scope is achieved through technical ways to assist the legislation.
