摘要
信息技术与教育教学高度融合的同时也面临着隐私泄露的风险,因此,在推进教育信息化的过程中,保护教学空间内的隐私信息就显得尤为重要。在对我国《民法典》《个人信息保护法》以及《刑法》中关于个人隐私信息保护的法律规范进行分析的基础上,认为应确保教学主体对个人隐私的自主控制,并强调教学空间内的信息收集和处理应当符合法律规定。同时,应该在教育信息化发展和教育空间隐私保护两者之间寻找一个恰当的平衡点,以构建教学空间内隐私信息保护的活性化机制。
The high integration of information technology and education and teaching also faces the risk of privacy leakage.In the process of advancing education informatization,it is particularly important to protect private information in the teaching space.Through the analysis of the laws and regulations on the protection of personal privacy information in the Corpus of Civil Law,Personal Information Protection Law,and Criminal Law,the independent control of personal privacy by the teaching subject is established,and the information collection and processing in the teaching space should comply with the legal requirements.At the same time,it is necessary to find a balance point of protection between the development of education informatization and the protection of education space privacy,and construct an activation mechanism for the protection of privacy information in the teaching space.
