城市居民文化参与权实现的现状及路径探析——以重庆市为例

Analysis on the Status Quo and Path of Realization of Urban Residents’Cultural Participation Right:A Case Study of Chongqing City

文化参与权作为文化权的重要组成部分,随着国家文化强国战略的推进而逐渐进入人们的视野。城市居民文化参与权的实现是城市居民文化需求、权利觉醒与国家全面推进依法治国和文化强国战略的对接点。调查发现,虽然城市居民文化参与权实现的内容日趋丰富,实现的程度也逐渐加深,但由于受传统思想、文化氛围、文化空间、参与动机、立法保障等因素的影响,城市居民文化参与权的实现存在着权利意识不足、主动性不强、救济途径匮乏与获得感不高等问题,应该从增强意识、公开信息、创新机制、压缩成本、完善立法等方面来拓宽城市居民文化参与权实现的路径。

The right of cultural participation is an important part of cultural rights.With the promotion of the national strategy of building a strong cultural country,it has gradually entered people’s vision.The realization of the right of cultural participation of urban residents is the docking point between the cultural needs and rights awakening of urban residents and the country’s strategy of comprehensively promoting the rule of law and cultural power.The survey found that although the content of the realization of urban residents’right to cultural participation is becoming richer and deeper.Due to the influence of traditional ideas,cultural atmosphere,cultural space,participation motivation,legislative guarantee and other factors,there are some problems in the realization of urban residents’right to cultural participation,such as lack of right awareness,weak initiative,lack of relief ways and low sense of acquisition.We should broaden the realization path of urban residents’right to cultural participation from the aspects of enhancing awareness,opening information,innovating mechanism,reducing cost and perfecting legislation.
