修订后的《反不正当竞争法》与《反垄断法》衔接适用

The Application of The Revised“Anti-Unfair Competition Law”and The“Anti-Monopoly Law”

我国《反不正当竞争法》已经修订并适用,删除了旧法中的五种不正当竞争行为,这不可避免地对《反垄断法》的适用和两部法律之间的衔接产生影响。通过对《反不正当竞争法》与《反垄断法》之间的衔接适用进行研究,以期促进我国竞争法的体系性协调,并针对上述两部法律在市场中的衔接适用提出合理化的对策建议。

China’s“Anti-Unfair Competition Law”has been revised and applied,and the five kinds of unfair competition behaviors in the old law have been deleted,which inevitably has an impact on the application of the“Anti-Monopoly Law”and the convergence between the two laws.On this basis,this paper studies the cohesive application between the“Anti-Unfair Competition Law”and the“Anti-Monopoly Law”,promotes the systematic coordination of China’s competition law,and puts forward reasonable Suggestions on the cohesive application of the two laws in the market.
