摘要
出入境人工智能法治应用是一把“双刃剑”,在赋能人类出入境迁徙的同时,也带来技治主义。基于我国出入境人工智能法治应用的政策推动、财政支持及相互融合,实证分析技治主义的算法歧视、问责真空、过度依赖等问题,提出构建全面评估、明确责任、增进融合的法治中国道路是解决该问题的有效路径。
The application of artificial intelligence entry-exit field is a“double-edged sword”,which not only empowers human beings to migrate,but also brings about technocracy.Based on the policy promotion,financial support of AI’s application and mutual integration,this paper conducts an empirical analysis of the problems with technocracy,such as algorithm discrimination,accountability vacuum and over-dependence,and proposes that building a Chinese approach of rule of law with comprehensive assessment,clear responsibility and enhanced integration is an effective way to solve this problem.
