摘要 《中国特色社会主义法律体系》白皮书将教育法视为行政法的子部门,理论界则将这种观点称为隶属说。在区分主要规范和次要规范后,从主要规范的视角来看,隶属说能够成立。因此,未来的教育法典应当纳入行政法典分则。为减少争议和工作量,编纂教育法典应当以教育类法律和部分教育类行政法规为基础。在结构上,教育法典可以由通则、学前教育、义务教育、高等教育、民办教育、职业教育、国防教育以及学校工作等分编组成。通则相当于教育法典的总则,其他各分编相当于分则。教育法典通则分编的内容以教育法和教师法为基础,但立法目的条款、管理体制条款和法律责任条款等条款须加以简化或删改。 In the white paper on the Socialist Legal System with Chinese Characteristics,e-ducation law is regarded as a sub-department of administrative law,which is called"subordination theory"in theory.After distinguishing the main norms from the secondary norms,the subordination theory can be established.Therefore,the future education code should be incorporated into administrative code.In order to reduce disputes and workload,the education code should be compiled on the basis of educational laws and some administrative regulations on education.In terms of structure,the education code can be composed of general provisions,preschool education,compulsory education,higher education,private education,vocational education,national defense education,school work,etc.The general provisions are equivalent to the general provisions of the education code,while the other chapters axe equivalent to sub-provisions.The contents of the general provisions of the education code are based on the Education Law and Teacher's Law,but the provisions of legislative purpose,administrative system and legal liability must be simplified or deleted correspondingly.
