互联网资本无序扩张的反垄断规制

The Anti-monopoly Regulation of Disorderly Expansion of Internet Capital

“强化反垄断与防止资本无序扩张”是2020年底中央为互联网行业发展提出的新要求。这一方面要求我们对互联网行业继续保持“包容审慎”的规制态度,另一方面也要坚决防范互联网企业的垄断行为。传统反垄断执法对于多数垄断行为均能形成有效规制,但互联网生态圈的打造为互联网行业的发展赋予了新的特征,也在部分层面冲击着传统的反垄断执法理念。这些难点主要表现为互联网相关市场的界定与新型垄断行为的认定。对于前者,可以通过界定细分服务和细分地域的方式予以解决;对于后者则需要结合互联网行业的创新特性强化反垄断执法。

"Opposing monopoly strongly and preventing disorderly expansion of capital"is a new requirement put forward by the central government for the development of the Internet industry at the end of 2020.On the one hand,it requires us to continue to maintain an"inclusive and prudent"regulatory attitude towards the Internet industry On the other hand,we should resolutely prevent the monopoly behaviors of Internet enterprises.The traditional anti-monopoly law enforcement can effectively regulate most monopoly behaviors.However,the creation of the In ternet ecosystem has given new characteristics to the development of the Internet industry and also impacted the traditional anti-monopoly law enforcement concept at some levels.These difficulties are mainly reflected in the definition of Internet-related markets and the identification of new monopoly behaviors.The former can be solved by defining subdivided services and subdivided regions;for the latter,we need to strengthen anti-monopoly law enforcement,taking into account the innovative characteristics of the Internet industry.
