文创产业著作邻接权保护路径探析

我国加强法治国家建设需要加快形成完备的法律规范体系,引领和推动实践发展、社会进步。文创产业作为经济文化领域较新鲜的事物,对于文化市场、经济市场繁荣发展的价值不可忽视。因此,为了规避文创产业发展过程中存在的阻力以及文创主体权益可能受到的侵害,需要在明确保护主体、对象、内容、前提条件的基础上,与时俱进做好相关法律法规的研究,健全惩罚性赔偿制度,加强著作邻接权保护的机构协作与人才培养,创新保护方式,做好法治宣传,以期加强对文创产业著作邻接权的保护。

To build a rule of law country,China needs to speed up the formation of a complete legal norm system to lead and promote practical development and social progress.As a relatively new thing in the field of economy and culture,the cultural and creative industry has a remarkable value to the prosperity and development of the cultural market and economic market.Therefore,in order to avoid the resistance in the development of cultural and creative industry and the possible infringement of the rights and interests of the owners of cultural and creative works,it is necessary to keep pace with the times;do a good job in the research of relevant laws and regulations;improve the punitive compensation system;strengthen the institutional cooperation and talent training on the protection of copyright-related neighboring rights;innovate the protection methods;and increase publicity of relevant laws on the basis of clarifying the providers,recipients,contents and preconditions of the protection,so as to strengthen the protection of neighboring rights of works in the cultural and creative industry.
