Improving the Dispute Settlement Model and Building a Mechanism for the Belt and Road initiative

作为一个开放、包容的国际区域经济合作网络,“一带一路”沿线各国有着不同的历史文化背景,造就了不同的政治体制、法律体系。面对现状,当前的贸易争端解决机制已然不足以应对“一带一路”的实际需求。一方面,可以在现有BIT的模式基础上进行完善,另一方面亦可结合“一带一路”特色,建立适合“一带一路”特色的投资争端解决专门部门。

As an open and inclusive international regional economic cooperation network,the countries along the“Belt and Road”have different historical and cultural backgrounds,creating different political and legal systems.Faced with the status quo,the current trade dispute settlement mechanism is no longer sufficient to meet the actual needs of the“Belt and Road”initiative.On the one hand,it can be improved on the basis of the existing BIT model.On the other hand,it can also be combined with the characteristics of the“Belt and Road”to establish a special investment dispute settlement department suitable for the characteristics of the“Belt and Road”.
