论民事案件管理视角下的程序分流

On the Procedural Diversion from the Perspective of Civil Case Management

日益增加的司法需求与相对稳定的司法资源之间不均衡、不匹配的矛盾始终是束缚我国民事司法制度有序运作的一道枷锁,如何消解二者之间的张力,为不同案件匹配相适应的程序和解决方法,在公正的前提下优化案件处置效益,是当前我国民事司法改革必须面对的一大问题。案件管理是一种分配解纷资源的手段,是实现程序分流的基础和保障。经过多年的实践摸索和理论探讨,我国民事案件管理机制仍存在参与主体缺乏多元性、分流标准不明确、分流操作不规范和分流流程不统一等弊端。未来的民事案件分流改革,需从确立案件管理指导原则、扩充案件分流参与主体、明确案件分流方式与标准、规范案件分流操作流程等方面着手,进一步健全我国民事案件程序分流管理机制,以有效破解法院"案多人少"的困局。

The contradiction between the increasing judicial demand and the relatively stable judicial resources is always a shackle that constrains the normal and orderly operation of China’s civil justice system.How to eliminate the tension between the two,match the appropriate procedures and solutions for different cases,and optimize the efficiency of case handling under the premise of fairness is a major problem that must be faced in China’s current civil judicial reform.Case management as a means of allocating resources is the basis and guarantee for the realization of procedural diversion.After years of practical exploration and theoretical discussion,China’s civil case management mechanism still has shortcomings such as lack of diversity of participants,unclear standard of diversion,irregular operation of diversion and inconsistent diversion process.In the future reform,we need to further improve the mechanism of civil case procedure diversion management from the aspects of establishing the guiding principles for case management,expanding the participation of case diversion,clarifying the ways and standards of case diversion,and standardizing the operation process of case diversion,to solve the dilemma of“judicial caseload”effectively in China.
