On the Legitimacy of Exclusive Licensing of Digital Music--From the Perspective of Law and Economics

阐述独家授权构成要素因符合法律规定和意思自治原则而具备合法性,其作为替代和弥补集体管理组织不完善的集中授权机制而具备正当性基础;指出数字音乐独家授权有利于促进市场有效竞争并发挥规模经济效应。以法经济学理论为视角,阐述了数字音乐独家授权可以提高交易效率、传播效率和版权保护效率,增加消费者福利。

This article explains that the constituent elements of exclusive licensing have legitimacy due to compliance with legal provisions and the principle of honesty and integrity,and they have a legitimacy foundation as a replacement and compensation for the imperfect centralized authorization mechanism of collective management organizations.It points out that exclusive licensing of digital music is conducive to promoting effective market competition and exerting economies of scale.From the perspective of law and economics theory,it analyzes that it can improve the efficiency of transaction,communication and copyright protection,thereby increase consumer welfare.
