摘要
本文主要利用《清代新疆档案选辑》及相关资料,采用新制度经济学中的权利束概念,以土地处置权、收益权、使用权的分割及转化为框架,以数据分析为切入点,揭示吐鲁番葡萄园不仅存在与中国东部地区相同的地权结构,还存在典地与典租之间的灵活转换,以及债务清偿中的典地式清偿与典租式清偿的多种模式。这一切,不仅构成吐鲁番葡萄园借贷的特征,也可能构成传统时代借贷市场或金融市场的基本特征。
This essay utilizes recently published documents from The Selected Archives of Xinjiang in the Qing Dynasty and related historical archives,and adopts the new institutional economics theory of bundle of rights to study the structure of land tenure in vineyards in Turpan,Xinjiang.Taking the division and transformation of land disposal rights,income rights,and use rights as a framework,and data analysis as the starting point,the research reveals that Turpan vineyards not only had the same land tenure structure as that in eastern China,but there was also a relationship between land and land leases.This essay examines the unique phenomenon:flexible transformation between land-mortgage and rent-mortgage in Turpan,and the various models of land-mortgage and rent-mortgage in repayment.Discussing these issues,the author maintains that lending in Turpan vineyards represented the characteristics of the traditional lending and financial markets in microcosm.
