[目的/意义]解析社交媒体存档与被遗忘权冲突的内在机理并在此基础上调和两者间的多元冲突,对于促进社交媒体存档良性运行和可持续发展具有重要意义。[方法/过程]通过对社交媒体存档的实践逻辑和被遗忘权的权能配置进行考察,分析社交媒体存档与被遗忘权冲突的主要原因、具体表征及潜在影响,进而提出平衡社交媒体存档与被遗忘权冲突的可能路径。[结果/结论]存档主体实际面对被遗忘权的挑战时,应着眼于被遗忘权保护的相对性,依照比例原则实现个案中的利益平衡,同时应当预先“通过设计保护个人信息”,尽可能在源头上抑制冲突的产生。

[Purpose/significance]It is of great significance to analyze the internal mechanism of the conflict between social media archiving and right to be forgotten,and on this basis to analyze the multiple conflicts between them,so as to promote the sustainable development of social media archiving.[Method/process]By investigating the practical logic of social media archiving and the structure of right to be forgotten,and analyzing the main causes,manifestations and potential impacts of the conflict between social media archiving and right to be forgotten,this paper proposes a possible path to balance the conflict between social media archiving and right to be forgotten.[Result/conclusion]When the archiving subject is faced with right to be forgotten,it should consider the relativity of right to be forgotten,and achieve the balance of interests in the case according to the principle of proportion.Besides,it should adhere to the principle of“Data Protection by Design”in advance,so as to restrain the conflict at the source as far as possible.
