中国特色国家监察权的法治化建构策略——基于对监察“二法一例”法治化建构的系统性观察

The Constructing Strategy of the Rule of Law of the National Supervision Power with Chinese Characteristics——Based on the Systematic Observation of Current Legislations of"Two Acts and One Regulation"

基于权能集成与功能再造而生成的国家监察权,已经成为中国特色国家权力体系的重要组成部分。监察权的法治化,是"中国式"法治主义与法治国家建设的基础。基于权力结构功能性均衡与人权保护二元维度的考察,国家监察权法治化的进展尚存在短板。基于优化权利保障、均衡权力结构、统一法秩序及正当程序的要求,亟待从留置措施、权力结构关系与监察调查程序三个方面提升监察权法治化的标准,通过渐进性的完善方案推进法治化目标的实现。

The national supervision power based on power integration and function reengineering has become an important part of the state power system with Chinese characteristics.The legalization of supervision power is the basis of"Chinese style"rule of law and the construction of a country ruled by law.Based on the investigation of functional balance of power structure and human rights protection,there are still shortcomings in the progress of the legalization of supervision power.Based on the requirements of optimizing right protection,balancing power structure,unifying legal order and due process,it is urgent to improve the standard of legalization of supervision power from the following three aspects:supervision detention measures,power structure relationships and procedure of supervision investigation,realizing the goal of legalization through gradual improvement scheme.
