房屋装饰装修残值造价鉴定探析--以具体诉讼案为例

房屋合同纠纷案件中装饰装修的处理,一直是司法审判中的热点和难点。结合一则诉讼案例,按法院委托对案涉房产的装饰装修残值进行鉴定。通过对房屋不同部位、不同时间装修情况,依据《房地产估价规范》的年龄——寿命法计算出房屋装饰装修各部分费用残值,针对原告及被告质证问题,参照租赁合同纠纷案件司法解释等,对装饰装修价值进行折旧率分析,并给出装饰装修残值的鉴定意见,为司法判定提供依据。同时,为房屋装饰装修残值的司法鉴定提供科学、公正和合规的参考案例及方法,以期给类似鉴定工作提供借鉴。

The treatment of decoration in the housing contract dispute cases has been a hot spot and difficult in the judicial trial.This article combines with a litigation case,according to the court entrusted to identify the residual value of the relevant property.Through the decoration of different parts and different times of the house,according to the age of the《Real Estate Appraisal Code》——life method calculates the residual value of the cost of the house decoration,analyzes the depreciation rate of the value of the dispute case of the lease contract,and gives the opinions on the identification of the residual value of the decoration,so as to provide a basis for the judicial judgment.At the same time,to provide scientific,fair and compliant reference cases and methods for the judicial appraisal of housing decoration residues,in order to provide reference for the peer similar appraisal work.
