信息对警察活动是不可缺少的。关于警察对信息的管理,实务中认可的一种做法是如果信息在获取时是合法的,对信息进行管理则是理所当然的。但这与理论产生了冲突,因为保存信息是宪法讨论的对象,至少需要法律的依据才能建立数据库。试图在两者之间架起桥梁并不容易,也很难期待短期内制定出合适的法律。所以,当前通过充实行政法律规则,加强实际控制是最现实的方案。

Information is indispensable to police activities.Without adequate information acquisition,accumulation and utilization,appropriate police activities cannot be carried out under optimal resource allocation and the purpose of police setting cannot be realized.The collection,accumulation and utilization of police information should not only fully ensure the safety of the public,but also ensure the appropriateness and eliminate the uneasiness of the public.With regard to police management of information,it is recognized in practice that the management of information is a matter of course if it is lawful at the time of acquisition.But this theory is in conflict,because the preservation of information is a constitutional issue,and at least a legal basis is needed to create a database.Trying to bridge the gap between the two is not easy,nor is it easy to expect appropriate legislation to be enacted in the short term.Therefore,it is the most realistic plan to strengthen the actual control through the enrichment of administrative rules.
